Hukuk Dairesi &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;2021\/7102 E. &nbsp;, &nbsp;2021\/11004 K.<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;\u0130\u00e7tihat Metni&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MAHKEMES\u0130 :ASL\u0130YE HUKUK MAHKEMES\u0130<br><br>Taraflar aras\u0131ndaki tazminat davas\u0131n\u0131n mahkemece yap\u0131lan yarg\u0131lamas\u0131 sonucunda, davan\u0131n k\u0131smen kabul\u00fcne y\u00f6nelik olarak verilen karar\u0131n, s\u00fcresi i\u00e7inde taraflarca temyiz edilmesi \u00fczerine; temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra, dosya i\u00e7erisindeki ka\u011f\u0131tlar okunup gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Y A R G I T A Y K A R A R I<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Davac\u0131, daval\u0131 &#8230; \u015firketinden 2010 model &#8230; marka arac\u0131 30\/03\/2010 tarihinde sat\u0131n ald\u0131\u011f\u0131n\u0131, araca 100.000 km kadar garanti verilerek sat\u0131\u015f yap\u0131ld\u0131\u011f\u0131n\u0131, sat\u0131n ald\u0131ktan sonra rutin bak\u0131mlar\u0131n\u0131 da yetkili servise yapt\u0131rd\u0131\u011f\u0131n\u0131, 16\/03\/2013 tarihinde arac\u0131n ar\u0131zalanmas\u0131 nedeniyle yetkili servise ba\u015fvurdu\u011funu, ara\u00e7ta olu\u015fan hasar\u0131n garanti kapsam\u0131nda olmad\u0131\u011f\u0131n\u0131n s\u00f6ylendi\u011fini, daval\u0131lardan sat\u0131c\u0131 ve servis olan &#8230; taraf\u0131ndan ara\u00e7ta hangi par\u00e7alar\u0131n de\u011fi\u015fece\u011fine ili\u015fkin d\u00f6k\u00fcm yap\u0131larak fiyat bildirildi\u011fini, kendisinden 13.224,01 TL al\u0131nd\u0131\u011f\u0131n\u0131, arac\u0131n tamir i\u00e7in 24 g\u00fcn serviste kald\u0131\u011f\u0131n\u0131 ve bu s\u00fcre i\u00e7inde kendisine ara\u00e7 tahsis edilmedi\u011fini, ara\u00e7 kiralamas\u0131 nedeniyle kira bedeli olarak toplam 3.147,00 TL \u00f6dedi\u011fini, <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">arac\u0131n motoruna proje \u00e7izdirip 350,00 TL \u00f6dedi\u011fini, ara\u00e7ta meydana gelen hasar nedeniyle en az 5.000,00 TL de\u011fer kayb\u0131n\u0131n olu\u015ftu\u011funu ileri s\u00fcrerek 13.224,01 TL nin, 3.147,00 TL ara\u00e7 kiralama bedelinin, tespit dosyas\u0131nda yap\u0131lan 438,85 TL yarg\u0131lama giderinin, fazlaya ili\u015fkin haklar\u0131 sakl\u0131 kalmak kayd\u0131yla 1.000,00 TL ara\u00e7ta meydana gelen de\u011fer azalmas\u0131n\u0131n, arac\u0131n motoruna \u00e7izdirilen proje ile bunlar\u0131n resmile\u015ftirilmesinden do\u011facak harcamalar\u0131n \u015fimdilik 350,00 TL\u2019sinin toplam\u0131 olan 18.159,86 TL\u2019nin daval\u0131lardan m\u00fc\u015ftereken ve m\u00fcteselsilen tahsiline karar verilmesini istemi\u015f; 16\/05\/2014 tarihli \u0131slah dilek\u00e7esiyle talebini 20.859,86 TL olarak \u0131slah etmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Daval\u0131lar, ayr\u0131 ayr\u0131 davan\u0131n reddini dilemi\u015flerdir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Mahkemece, davan\u0131n k\u0131smen kabul\u00fc ile, 20.421,01 TL alaca\u011f\u0131n dava tarihinden itibaren i\u015fleyecek yasal faizi ile birlikte daval\u0131lardan al\u0131narak davac\u0131ya verilmesine, fazlaya ili\u015fkin istemin reddine, dair verilen karar Yarg\u0131tay (kapat\u0131lan) 13. Hukuk Dairesi\u2019nin 30\/03\/2016 tarih ve 2015\/4442 Esas ve 2016\/9069 Karar say\u0131l\u0131 ilam\u0131yla yetersiz rapora dayal\u0131 olarak h\u00fck\u00fcm tesis edilmesi gerek\u00e7esiyle bozulmu\u015f, bozmaya uyularak mahkemece davan\u0131n k\u0131smen kabul\u00fc ile, 16.721,01 TL\u2019nin dava tarihinden itibaren i\u015fleyecek yasal faizi ile birlikte daval\u0131lardan al\u0131narak davac\u0131ya verilmesine, fazlaya ili\u015fkin istemlerin reddine, karar verilmi\u015f, h\u00fck\u00fcm, taraflarca temyiz edilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/hukuk.name\/wp-content\/uploads\/2021\/12\/5-Sonuc-9.png\" alt=\"\" class=\"wp-image-1699\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><br>1-Dosyadaki yaz\u0131lara, bozmaya uyularak karar verilmi\u015f olmas\u0131na ve delillerin takdirinde bir isabetsizlik bulunmamas\u0131na g\u00f6re, davac\u0131 ve daval\u0131lar\u0131n a\u015fa\u011f\u0131daki bentlerin kapsam\u0131 d\u0131\u015f\u0131nda kalan sair temyiz itirazlar\u0131n\u0131n reddi gerekir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong> <strong><a href=\"http:\/\/hukuk.name\/?p=1696\">Ara\u00e7 kira bedeli<\/a><a href=\"https:\/\/hukuk.name\/?p=1686\"> <\/a>makul s\u00fcreyle \u00f6denir.<\/strong> <\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><br>2-Daval\u0131lar\u0131n ara\u00e7 kiralama bedeli y\u00f6n\u00fcnden temyiz itirazlar\u0131 bak\u0131m\u0131ndan;<br>Davac\u0131, daval\u0131 \u015firketten sat\u0131n ald\u0131\u011f\u0131 davaya konu ara\u00e7ta meydana gelen ar\u0131za nedeniyle olu\u015fan hasar\u0131n garanti kapsam\u0131nda bedelsiz tamir edilmedi\u011fini ileri s\u00fcrerek, \u00f6dedi\u011fi bedelin, ara\u00e7ta de\u011fer kayb\u0131n\u0131n ve ara\u00e7 kiralama bedelinin tahsili i\u00e7in eldeki davay\u0131 a\u00e7m\u0131\u015f, daval\u0131lar davan\u0131n reddini dilemi\u015ftir. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Mahkemece, dava konusu ara\u00e7 \u00fczerinde yap\u0131lan inceleme sonucu haz\u0131rlanan bilirki\u015fi raporu benimsenmek suretiyle davan\u0131n k\u0131smen kabul\u00fcne karar verilmi\u015ftir. Taraflar aras\u0131nda g\u00f6r\u00fclen davada, davac\u0131 di\u011fer talepleri yan\u0131nda ay\u0131pl\u0131 ara\u00e7tan yararlanamad\u0131\u011f\u0131 s\u00fcreler i\u00e7in kiralad\u0131\u011f\u0131 ara\u00e7lar nedeniyle \u00f6demek zorunlu kald\u0131\u011f\u0131 ara\u00e7 kiralama \u00fccretleri y\u00f6n\u00fcnden de talepte bulunmu\u015f, mahkemeye de ara\u00e7 kiralamaya ili\u015fkin fatura sunmu\u015ftur. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ara\u00e7 kiralama faturalar\u0131n\u0131n incelenmesinde 30\/03\/2013 tarihli ve 08\/04\/2013 tarihli iki fatura toplam\u0131n\u0131n 3.147,00 TL oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Dosya i\u00e7erisinde yer alan 23\/11\/2017 tarihli bilirki\u015fi raporunda, davac\u0131 taraf\u00e7a benzer bir arac\u0131n kiralanmas\u0131 halinde 1.650,00 TL ara\u00e7 kiralama bedelinin makul olaca\u011f\u0131 belirlendi\u011finden, davac\u0131n\u0131n ara\u00e7tan yararlan\u0131lamad\u0131\u011f\u0131, arac\u0131n serviste kald\u0131\u011f\u0131 g\u00fcn kadar hak ve nesafet \u00f6l\u00e7\u00fcleri g\u00f6zetilerek adil arac\u0131n kiralama bedeli belirlenmek suretiyle taraf ve Yarg\u0131tay denetimine uygun ek bilirki\u015fi raporu al\u0131nd\u0131ktan sonra h\u00fck\u00fcm tesisi gerekirken, aksine d\u00fc\u015f\u00fcncelerle davac\u0131n\u0131n sundu\u011fu faturalara g\u00f6re bu talebinin t\u00fcmden kabul edilmi\u015f olmas\u0131 usul ve yasaya ayk\u0131r\u0131 olup, bozma nedenidir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Tek vekalet \u00fccreti<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><br>3-Davac\u0131n\u0131n daval\u0131lar lehine ayr\u0131 ayr\u0131 vekalet \u00fccretine h\u00fckmedilmesi y\u00f6n\u00fcnden temyiz itirazlar\u0131 bak\u0131m\u0131ndan;<br>Karar tarihinde y\u00fcr\u00fcrl\u00fckte olan 2018 tarihli Avukatl\u0131k Asgari \u00dccret Tarifesinin \u201cAvukatl\u0131k \u00fccretinin aidiyeti, s\u0131n\u0131rlar\u0131 ve ortak veya de\u011fi\u015fik sebeple davan\u0131n reddinde daval\u0131lar\u0131n avukatl\u0131k \u00fccreti\u201d ba\u015fl\u0131kl\u0131 3. maddesinin 2. f\u0131kras\u0131nda yer alan \u2018M\u00fcteselsil sorumluluk da dahil olmak \u00fczere, birden fazla daval\u0131 aleyhine a\u00e7\u0131lan davan\u0131n reddinde, ret sebebi ortak olan daval\u0131lar vekili lehine tek, ret sebebi ayr\u0131 olan daval\u0131lar vekili lehine ise her ret sebebi i\u00e7in ayr\u0131 ayr\u0131 avukatl\u0131k \u00fccretine h\u00fckmolunur.\u2019 d\u00fczenlemesine g\u00f6re daval\u0131lar yarar\u0131na tek vekalet \u00fccretine h\u00fckmedilmesi gerekirken ayn\u0131 sebeple reddedilen dava bak\u0131m\u0131ndan daval\u0131lar yarar\u0131na ayr\u0131 ayr\u0131 vekalet \u00fccretine h\u00fckmedilmesi usul ve yasaya ayk\u0131r\u0131 olup, bozma nedenidir.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Ara\u00e7 kira bedeli makul s\u00fcreyle \u00f6denir.
