Hukuk Dairesi 2014\/33390 E. , 2016\/4940 K.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>&#8220;\u0130\u00e7tihat Metni&#8221;<br>MAHKEMES\u0130: \u0130\u015e MAHKEMES\u0130<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Y A R G I T A Y K A R A R I<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><br>A) Davac\u0131 \u0130steminin \u00d6zeti:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Davac\u0131, daval\u0131n\u0131n, i\u015fyerlerinde muhasebe uzman\u0131 olarak \u00e7al\u0131\u015f\u0131rken hizmet s\u00fcresinin 15 y\u0131ldan, prim \u00f6deme g\u00fcn say\u0131s\u0131n\u0131n ise 3600 g\u00fcnden fazla olmas\u0131 nedeni ile 1475 Say\u0131l\u0131 \u0130\u015f Kanunu\u2019nun 14\/f.(5) maddesi gere\u011fi emeklili\u011fi hak etti\u011finden 15.05.2013 tarihinde istifa ederek i\u015ften ayr\u0131ld\u0131\u011f\u0131n\u0131 ve davac\u0131 \u015firketin daval\u0131ya 3.920,17 TL k\u0131dem tazminat\u0131 verdi\u011fini, daval\u0131n\u0131n i\u015ften ayr\u0131ld\u0131ktan k\u0131sa bir s\u00fcre sonra 20.05.2013 tarihinde ba\u015fka bir i\u015f yerinde \u00e7al\u0131\u015fmaya ba\u015flad\u0131\u011f\u0131n\u0131, <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">1475 say\u0131l\u0131 Yasa\u2019ya g\u00f6re ba\u015fka bir i\u015fyerinde \u00e7al\u0131\u015fmaya ba\u015flayan i\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanamayaca\u011f\u0131n\u0131, daval\u0131n\u0131n daha \u00f6nce de \u00e7al\u0131\u015ft\u0131\u011f\u0131 yerden emeklilik nedeni ile ayr\u0131l\u0131p k\u0131dem tazminat\u0131 alarak ba\u015fka bir yerde \u00e7al\u0131\u015fmaya ba\u015flad\u0131\u011f\u0131n\u0131, daval\u0131n\u0131n s\u00f6z konusu davran\u0131\u015f\u0131 al\u0131\u015fkanl\u0131k haline getirdi\u011fini, ileri s\u00fcrerek daval\u0131ya \u00f6denen<br>3.920.17 TL\u2019nin iadesini, istemi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>B) Daval\u0131 Cevab\u0131n\u0131n \u00d6zeti:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Daval\u0131, i\u015ften ayr\u0131lmas\u0131 konusunda i\u015f akdi devam ederken davac\u0131 i\u015fvereni ayr\u0131nt\u0131l\u0131 olarak<br>bilgilendirdi\u011fini, i\u015f akdinin sonland\u0131r\u0131lmas\u0131 i\u00e7in kar\u015f\u0131l\u0131kl\u0131 var\u0131lan mutabakat sonucu taraf\u0131na k\u0131dem<br>tazminat\u0131 \u00f6dendi\u011fini, k\u0131dem tazminat\u0131 almaya hak kazand\u0131\u011f\u0131n\u0131n davac\u0131 i\u015fverence kabul edildi\u011fini,<br>alacaklar\u0131 hesaplan\u0131p haklar\u0131n\u0131n \u00f6denip i\u015ften \u00e7\u0131kar\u0131lmas\u0131n\u0131n i\u015fverence kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131, <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">ihbar \u00f6nellerine uygun olarak i\u015f akdinin sonlanmas\u0131n\u0131 davac\u0131dan istedi\u011fi halde davac\u0131n\u0131n i\u015f akdini sonland\u0131rarak k\u0131dem tazminat\u0131 \u00f6dedi\u011fini ve ihbar \u00f6neli i\u00e7in kalan s\u00fcre kadar(13 g\u00fcn) kesinti yapt\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n kabul etti\u011fi borcuna kar\u015f\u0131l\u0131k yapm\u0131\u015f oldu\u011fu \u00f6demeyi geri istemesinin anlams\u0131z oldu\u011funu, kar\u015f\u0131l\u0131kl\u0131 mutabakata g\u00f6re yap\u0131lan \u00f6demenin geri istenmesinin hukuka uygun bulunmad\u0131\u011f\u0131n\u0131, davan\u0131n reddini istemi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>C) Yerel Mahkeme Karar\u0131n\u0131n \u00d6zeti:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Mahkemece, toplanan kan\u0131tlar ve bilirki\u015fi raporuna dayan\u0131larak, Yarg\u0131tay kararlar\u0131nda belirtildi\u011fi \u00fczere i\u015f\u00e7inin emeklilik sebebiyle i\u015ften ayr\u0131ld\u0131ktan sonra ba\u015fka bir i\u015fyerinde \u00e7al\u0131\u015fmas\u0131n\u0131n, \u00e7al\u0131\u015fma hakk\u0131n\u0131n Anayasal bir hak oldu\u011fu gerek\u00e7esiyle hakk\u0131n k\u00f6t\u00fcye kullan\u0131lmas\u0131 olarak de\u011ferlendirilemeyece\u011fi, daval\u0131n\u0131n emeklilik hakk\u0131n\u0131 kullanarak i\u015fyerinden ayr\u0131ld\u0131\u011f\u0131 bu nedenle i\u015fverence \u00f6denen k\u0131dem tazminat\u0131n\u0131n geri istenemeyece\u011fi, gerek\u00e7esi ile davan\u0131n reddine karar verilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>D) Temyiz:<br>Karar\u0131 davac\u0131 taraf temyiz etmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>E) Gerek\u00e7e:<br>Davac\u0131 \u015firket, daval\u0131n\u0131n i\u015ften \u00e7\u0131k\u0131\u015f sebebinin ger\u00e7ekte ya\u015f hari\u00e7 emeklilik sebebi olmad\u0131\u011f\u0131n\u0131 ba\u015fka bir yerde i\u015f buldu\u011fu i\u00e7in i\u015ften ayr\u0131ld\u0131\u011f\u0131n\u0131 ve ayr\u0131ca \u00f6nce \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fyerinde de ayn\u0131 sebeple ayr\u0131l\u0131p k\u0131dem tazminat\u0131 ald\u0131\u011f\u0131n\u0131 ileri s\u00fcrerek \u00f6dedikleri k\u0131dem tazminat\u0131n\u0131n iadesini talep etmi\u015ftir. Ayr\u0131ca bu iddias\u0131na dayanak olarak bir k\u0131s\u0131m yaz\u0131\u015fmalar ve davac\u0131n\u0131n daha \u00f6nce \u00e7al\u0131\u015ft\u0131\u011f\u0131 belirtilen &#8230; Tekstil San. Ve Tic. Ltd. \u015eirketi taraf\u0131ndan verilen yaz\u0131y\u0131 sunmu\u015ftur.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Mahkemece davac\u0131 \u015firketin davas\u0131 yaz\u0131l\u0131 gerek\u00e7e ile red edilmi\u015f ise de bu red eksik incelemeye dayal\u0131d\u0131r.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/hukuk.name\/wp-content\/uploads\/2021\/12\/5-Sonuc-1.png\" alt=\"\" class=\"wp-image-1642\"\/><\/figure>\n\n\n\n<h2 class=\"wp-block-heading\"> <strong>Bir kez kullan\u0131labilecek<\/strong> <\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Normal tahsis ama\u00e7l\u0131 emeklilik ya da ya\u015f hari\u00e7 emeklilik ko\u015fullar\u0131n\u0131n olu\u015fmas\u0131 halinde ayr\u0131lmalardan do\u011fan k\u0131dem tazminat\u0131 hakk\u0131 bir kez kullan\u0131labilecek haklardand\u0131r. I\u015f\u00e7i bu hakk\u0131 bir kez kulland\u0131\u011f\u0131nda bir sonraki \u00e7al\u0131\u015fma d\u00f6nemi i\u00e7in bu d\u00fczenlemelere dayanarak tekrar k\u0131dem tazminat\u0131 isteyemez.<\/strong> <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Bu itibarla Mahkemece yap\u0131lacak i\u015f, dava d\u0131\u015f\u0131 \u015firketin 21\/5\/2013 tarihli yaz\u0131s\u0131 hakk\u0131nda davac\u0131n\u0131n beyan\u0131n\u0131 al\u0131p \u00f6nceki \u00e7al\u0131\u015ft\u0131\u011f\u0131 bu \u015firketten ayr\u0131l\u0131\u015f \u015fekli ve tazminat al\u0131p almad\u0131\u011f\u0131 a\u00e7\u0131klatt\u0131r\u0131l\u0131p gerekirse ilgili \u015firketten \u00f6deme belgeleri isteyip davac\u0131n\u0131n 1475 say\u0131l\u0131 Kanunun 14\/5. maddesinde belirtilen hakk\u0131 daha \u00f6nce kullan\u0131p kullanmad\u0131\u011f\u0131n\u0131 netle\u015ftirip sonuca g\u00f6re karar vermektir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Eksik inceleme ve ara\u015ft\u0131rma ile sonuca gidilmesi hatal\u0131 olup bozmay\u0131 gerektirmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>F) Sonu\u00e7:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Temyiz olunan karar\u0131n, yukar\u0131da yaz\u0131l\u0131 sebepden dolay\u0131 BOZULMASINA, pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n<br>istek halinde ilgiliye iadesine 07\/03\/2016 tarihinde oybirli\u011fiyle karar verildi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Normal tahsis ama\u00e7l\u0131 emeklilik ya da ya\u015f hari\u00e7 emeklilik ko\u015fullar\u0131n\u0131n olu\u015fmas\u0131 halinde ayr\u0131lmalardan do\u011fan k\u0131dem tazminat\u0131 hakk\u0131 bir kez kullan\u0131labilecek haklardand\u0131r. \u0130\u015f\u00e7i bu hakk\u0131 bir kez kulland\u0131\u011f\u0131nda bir sonraki \u00e7al\u0131\u015fma d\u00f6nemi i\u00e7in bu d\u00fczenlemelere dayanarak tekrar k\u0131dem tazminat\u0131 isteyemez.
