Hukuk Dairesi &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;2017\/7353 E. &nbsp;, &nbsp;2017\/12859 K.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;\u0130\u00e7tihat Metni&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">MAHKEMES\u0130 :\u0130cra Hukuk Mahkemesi<br><br>Yukar\u0131da tarih ve numaras\u0131 yaz\u0131l\u0131 mahkeme karar\u0131n\u0131n m\u00fcddeti i\u00e7inde temyizen tetkiki bor\u00e7lu taraf\u0131ndan istenmesi \u00fczerine bu i\u015fle ilgili dosya mahallinden daireye g\u00f6nderilmi\u015f olup, dava dosyas\u0131 i\u00e7in Tetkik Hakimi &#8230; taraf\u0131ndan d\u00fczenlenen rapor dinlendikten ve dosya i\u00e7erisindeki t\u00fcm belgeler okunup incelendikten sonra i\u015fin gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc :<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>Sair temyiz itirazlar\u0131 yerinde de\u011fil ise de;<br>Alacakl\u0131 taraf\u0131ndan, bor\u00e7lular hakk\u0131nda \u00e7eke dayal\u0131 olarak, kambiyo senetlerine \u00f6zg\u00fc haciz yoluyla ba\u015flat\u0131lan takipte, \u00e7ekin ke\u015fidecisi olarak g\u00f6z\u00fcken bor\u00e7lu &#8230; Yol Asfaltlama \u2026 A\u015e.nin vekili icra mahkemesine ba\u015fvurarak, takibe konu \u00e7ekin, lehtar &#8230;A\u015e ile aralar\u0131ndaki hukuki ili\u015fkinin teminat\u0131 olarak d\u00fczenlendi\u011fini, \u00e7ekin arkas\u0131na da, m\u00fcvekkili \u015firket taraf\u0131ndan, \u201c<mark>i\u015f bu \u00e7ek teminat \u00e7eki olup, cirolanamaz ve icra takibine konu edilemez\u201d \u015ferhi i\u015flendi\u011fini<\/mark>, ancak \u00e7ekin \u00e7al\u0131n\u0131p, \u00e7ekin arkas\u0131ndaki \u015ferhin beyaz kimyasal bir madde ile kaplan\u0131p lehtara ait olmayan ka\u015fe ve imza kullan\u0131larak \u00e7ekin tedav\u00fcle s\u00fcr\u00fcld\u00fc\u011f\u00fcn\u00fc iddia ederek takibin iptalini talep etmi\u015f, mahkemece istemin reddine karar verilmi\u015ftir.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" src=\"https:\/\/hukuk.name\/wp-content\/uploads\/2021\/12\/5-Sonuc-4.png\" alt=\"\" class=\"wp-image-1660\"\/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><br>\u201cKe\u015fideci taraf\u0131ndan konacak bir kay\u0131tla, poli\u00e7enin cirosu yasaklanabilir. Senede, \u2018ciro olunmayaca\u011f\u0131\u2019 veya \u2018&#8230; yaz\u0131l\u0131 olmad\u0131\u011f\u0131\u2019 (menfi &#8230; kayd\u0131) konarak bu amaca ula\u015f\u0131labilir.
