davac\u0131 ile yap\u0131lan 14.09.2014 tarihli s\u00f6zle\u015fme uyar\u0131nca, A-Blok 3 numaral\u0131<strong> dairenin bedeli olan 600.000,00 USD&#8217;nin davac\u0131 taraf\u0131ndan daval\u0131 \u015firkete \u00f6dendi\u011fi ve&nbsp;<mark>ta\u015f\u0131nmaz\u0131n<\/mark>&nbsp;15.04.2015 tarihinde davac\u0131ya teslim edildi\u011fini, ancak arsa sahiplerinin d\u00fcr\u00fcstl\u00fck kural\u0131na ayk\u0131r\u0131 davranarak sat\u0131\u015f s\u00f6zle\u015fmesinin adi yaz\u0131l\u0131 yap\u0131ld\u0131\u011f\u0131ndan bahisle ge\u00e7ersizli\u011fini ileri s\u00fcrerek&nbsp;<mark>ta\u015f\u0131nmaz\u0131n<\/mark>&nbsp;devrini yapmad\u0131klar\u0131n\u0131, tapunun devredilememesinin arsa sahiplerini kusurundan kaynakland\u0131\u011f\u0131n\u0131, davay\u0131 kabul ettiklerini beyan ederek, yarg\u0131lama giderleri ve vek\u00e2let \u00fccretinden sorumlu tutulmamalar\u0131 gerekti\u011fini belirtmi\u015flerdir.<\/strong>Daval\u0131lar &#8230;, &#8230;, &#8230;, &#8230; ve &#8230; vekili; s\u00f6zle\u015fmeye g\u00f6re arsa sahiplerine b\u0131rak\u0131lan 9 adet ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn tamamlanmadan ve teslim edilmeden \u00f6nce 15.07.2014 tarihinde ge\u00e7ersiz olarak yap\u0131lan s\u00f6zle\u015fmeyle y\u00fckleniciye devredilece\u011finin kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131n\u0131, daval\u0131 arsa sahiplerinin harici olarak yap\u0131lan s\u00f6zle\u015fmenin ge\u00e7ersiz oldu\u011funu bilmediklerini, ilk \u00fc\u00e7 dairenin bedelini alarak daireleri devrettiklerini, s\u00f6zle\u015fmenin ge\u00e7erli olmad\u0131\u011f\u0131n\u0131 \u00f6\u011frendikten sonra y\u00fcklenicinin \u00f6demelerinden imtina ederek s\u00f6zle\u015fmenin ge\u00e7ersiz olmas\u0131 nedeniyle di\u011fer&nbsp;<mark>ta\u015f\u0131nmazlar\u0131<\/mark>&nbsp;devretmediklerini, davac\u0131n\u0131n 3. ki\u015fi olmas\u0131 nedeniyle iyiniyetli olmad\u0131\u011f\u0131n\u0131, daval\u0131 \u015firketin 3. ki\u015fiye ge\u00e7ersiz sat\u0131\u015f s\u00f6zle\u015fmesi ile dava a\u00e7t\u0131rd\u0131\u011f\u0131n\u0131, davac\u0131ya&nbsp;<mark>zilyetli\u011f<\/mark>in ge\u00e7mesinin m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131, davac\u0131n\u0131n sat\u0131\u015f s\u00f6zle\u015fmesinde taraf olmayan arsa sahiplerini daval\u0131 olarak g\u00f6steremeyece\u011fini, dava konusu hukuki ili\u015fkinin T\u00fcketici Mahkemesinin g\u00f6rev alan\u0131na girmedi\u011fini belirterek davan\u0131n reddini talep etmi\u015ftir.Mahkemece, bozma ilam\u0131na uyularak yap\u0131lan yarg\u0131lama sonucunda davan\u0131n kabul\u00fcne dair verilen karar, daval\u0131lar &#8230;, &#8230;, &#8230;, &#8230; ve &#8230; vekili taraf\u0131ndan s\u00fcresinde temyiz edilmi\u015ftir.<br>1-Dosyadaki yaz\u0131lara ve mahkemece uyulan bozma karar\u0131 gere\u011fince inceleme yap\u0131larak h\u00fck\u00fcm verilmi\u015f olmas\u0131na, delillerin takdirinde bir isabetsizlik bulunmamas\u0131na ve bozman\u0131n \u015f\u00fcmul\u00fc d\u0131\u015f\u0131nda kalarak kesinle\u015fen cihetlere ait temyiz itirazlar\u0131n\u0131n incelenmesi art\u0131k m\u00fcmk\u00fcn olmamas\u0131na g\u00f6re daval\u0131lar &#8230;, &#8230;, &#8230;, &#8230; ve &#8230;&#8217;\u00fcn a\u015fa\u011f\u0131daki bendin kapsam\u0131 d\u0131\u015f\u0131nda kalan di\u011fer temyiz itirazlar\u0131 yerinde g\u00f6r\u00fclmemi\u015f, reddi gerekmi\u015ftir.<br>2-Davac\u0131, haricen sat\u0131n ald\u0131\u011f\u0131&nbsp;<mark>ta\u015f\u0131nmaz\u0131n<\/mark>, tapu kayd\u0131n\u0131n ipt\u00e2li ve ad\u0131na tescilini talep etmi\u015f olup, mahkemece 14. Hukuk Dairesi&#8217;nin 09.07.2018 tarih ve 2015\/18427 Esas, 2018\/5188 Karar say\u0131l\u0131 bozma ilam\u0131na uyarak davan\u0131n kabul\u00fcne karar vermi\u015f ise de, bozma ilam\u0131nda, arsa sahiplerinin bir k\u0131s\u0131m ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin <strong>bedelini ald\u0131klar\u0131n\u0131 ve&nbsp;<mark>ta\u015f\u0131nmazlar\u0131n<\/mark>&nbsp;devrini ger\u00e7ekle\u015ftirdiklerini beyan etmeleri kar\u015f\u0131s\u0131nda,<\/strong> dava konusu&nbsp;<mark>ta\u015f\u0131nmazlar\u0131n<\/mark>&nbsp;devrinden ka\u00e7\u0131narak s\u00f6zle\u015fmenin ge\u00e7ersizli\u011finin ileri s\u00fcr\u00fclmesi iyiniyet kurallar\u0131yla ba\u011fda\u015fmayaca\u011f\u0131 kabul edilerek, taraflar\u0131n bor\u00e7lar\u0131n\u0131 eda edip etmedi\u011fini konusunda ara\u015ft\u0131rma yap\u0131lmas\u0131 gerekti\u011fi belirtilmi\u015f, mahkemece bozmaya uyulmu\u015f ise de, bozma gere\u011fince ara\u015ft\u0131rma yap\u0131lmam\u0131\u015ft\u0131r. <strong>Davac\u0131n\u0131n&nbsp;<mark>ta\u015f\u0131nmaz<\/mark>&nbsp;mal sat\u0131\u015f vaadi s\u00f6zle\u015fmelerine dayanan tescil isteminin h\u00fck\u00fcm alt\u0131na al\u0131nabilmesi i\u00e7in \u00f6ncelikle daval\u0131 y\u00fcklenicinin \u015firketin al\u0131c\u0131, daval\u0131 arsa sahiplerinin sat\u0131c\u0131 olarak bulundu\u011fu 15.07.2014 tarihli s\u00f6zle\u015fme gere\u011fince daire bedelinin \u00f6denmi\u015f olmas\u0131 gerekmektedir.Mahkemece yap\u0131lmas\u0131 gereken i\u015f; 15.07.2014 tarihli s\u00f6zle\u015fme uyar\u0131nca bu bedelin \u00f6denip \u00f6denmedi\u011fi ara\u015ft\u0131r\u0131l\u0131p, \u00f6denmemi\u015f ise, Bor\u00e7lar Kanunu 97. maddesi uyar\u0131nca dava konusu&nbsp;<mark>ta\u015f\u0131nmaz\u0131n<\/mark>&nbsp;rayi\u00e7 de\u011feri bulunarak ve daval\u0131 \u015firket vekilinin 20.12.2018 tarihli duru\u015fmadaki, &#8220;gerekirse ke\u015fif yap\u0131larak bedel belirlenip, depo etmeye haz\u0131r oldu\u011funa ili\u015fkin&#8221; beyan\u0131 da dikkate al\u0131narak,&nbsp;<mark>ta\u015f\u0131nmaz\u0131n<\/mark>&nbsp;bedeli belirlenip, bu miktar\u0131n daval\u0131 arsa sahiplerine \u00f6denmek \u00fczere depo edilmesi i\u00e7in s\u00fcre verilmesi, bedelin depo edilmesi halinde depo edilen bedelin arsa sahiplerine \u00f6denmek suretiyle \u015fimdiki gibi tescile karar verilmesi, aksi halde davan\u0131n reddine karar verilmesinden ibaret olmal\u0131d\u0131r.
