Bu s\u00fcreden fazla \u00e7al\u0131\u015fmas\u0131 halinde fazla \u00e7al\u0131\u015fm\u0131\u015f olur. (Bu fazla \u00e7al\u0131\u015fma \u00fccreti hesaplan\u0131rken haftal\u0131k toplam \u00e7al\u0131\u015fma s\u00fcresinden \u00f6\u011fle tatili ve dinlenme-\u00e7ay mola s\u00fcreleri d\u00fc\u015f\u00fcl\u00fcr. Kalan s\u00fcre 45 saatten fazla ise i\u015f\u00e7i fazla \u00e7al\u0131\u015fm\u0131\u015f olur.)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7i fazla \u00e7al\u0131\u015fma \u00fccretini, normal \u00e7al\u0131\u015fmadaki saat \u00fccretinin 1,5 kat\u0131 olarak al\u0131r.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7inin y\u0131ll\u0131k toplam fazla \u00e7al\u0131\u015fma s\u00fcresi en fazla 270 saattir. Ancak, bundan fazla \u00e7al\u0131\u015fmas\u0131 halinde de i\u015f\u00e7i fazla \u00e7al\u0131\u015fma \u00fccretini alabilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u0130\u015f\u00e7inin fazla \u00e7al\u0131\u015fma yapmas\u0131, i\u015f\u00e7inin onay\u0131na ba\u011fl\u0131d\u0131r. \u0130\u015f\u00e7inin r\u0131azs\u0131 olmadan, i\u015f\u00e7iye fazla mesai yapt\u0131r\u0131lamaz. Aksi halde i\u015f\u00e7inin i\u015f akdini hakl\u0131 olarak fesih hakk\u0131 do\u011far.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Fazla \u00e7al\u0131\u015fma her t\u00fcrl\u00fc delille, ancak \u00f6zellikle tan\u0131k beyanlar\u0131yla tespit edilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>FAZLA \u00c7ALI\u015eMA KANUN MADDES\u0130<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">4857 Say\u0131l\u0131 \u0130\u015f Kanununda &#8220;fazla \u00e7al\u0131\u015fma ve fazla \u00e7al\u0131\u015fma \u00fccreti&#8221; a\u015fa\u011f\u0131daki gibi tarif edilmi\u015ftir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Fazla \u00e7al\u0131\u015fma \u00fccreti<br>Madde 41 &#8211; <\/strong>\u00dclkenin genel yararlar\u0131 yahut i\u015fin niteli\u011fi veya \u00fcretimin art\u0131r\u0131lmas\u0131 gibi nedenlerle fazla \u00e7al\u0131\u015fma yap\u0131labilir. Fazla \u00e7al\u0131\u015fma, Kanunda yaz\u0131l\u0131 ko\u015fullar \u00e7er\u00e7evesinde, haftal\u0131k k\u0131rkbe\u015f saati a\u015fan \u00e7al\u0131\u015fmalard\u0131r. 63 \u00fcnc\u00fc madde h\u00fckm\u00fcne g\u00f6re denkle\u015ftirme esas\u0131n\u0131n uyguland\u0131\u011f\u0131<br>hallerde, i\u015f\u00e7inin haftal\u0131k ortalama \u00e7al\u0131\u015fma s\u00fcresi, normal haftal\u0131k i\u015f s\u00fcresini a\u015fmamak ko\u015fulu ile, baz\u0131 haftalarda toplam k\u0131rkbe\u015f saati a\u015fsa dahi bu \u00e7al\u0131\u015fmalar fazla \u00e7al\u0131\u015fma say\u0131lmaz.<br><strong>Her bir saat fazla \u00e7al\u0131\u015fma i\u00e7in verilecek \u00fccret normal \u00e7al\u0131\u015fma \u00fccretinin saat ba\u015f\u0131na d\u00fc\u015fen miktar\u0131n\u0131n y\u00fczde elli y\u00fckseltilmesi suretiyle \u00f6denir.<\/strong><br>Haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin s\u00f6zle\u015fmelerle k\u0131rkbe\u015f saatin alt\u0131nda belirlendi\u011fi durumlarda yukar\u0131da belirtilen esaslar dahilinde uygulanan ortalama haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresini a\u015fan ve k\u0131rkbe\u015f saate kadar yap\u0131lan \u00e7al\u0131\u015fmalar fazla s\u00fcrelerle \u00e7al\u0131\u015fmalard\u0131r. Fazla s\u00fcrelerle \u00e7al\u0131\u015fmalarda, her bir<br>saat fazla \u00e7al\u0131\u015fma i\u00e7in verilecek \u00fccret normal \u00e7al\u0131\u015fma \u00fccretinin saat ba\u015f\u0131na d\u00fc\u015fen miktar\u0131n\u0131n y\u00fczde yirmibe\u015f y\u00fckseltilmesiyle \u00f6denir.<br><strong>Fazla \u00e7al\u0131\u015fma veya fazla s\u00fcrelerle \u00e7al\u0131\u015fma yapan i\u015f\u00e7i isterse, bu \u00e7al\u0131\u015fmalar kar\u015f\u0131l\u0131\u011f\u0131 zaml\u0131 \u00fccret yerine, fazla \u00e7al\u0131\u015ft\u0131\u011f\u0131 her saat kar\u015f\u0131l\u0131\u011f\u0131nda bir saat otuz dakikay\u0131, fazla s\u00fcrelerle \u00e7al\u0131\u015ft\u0131\u011f\u0131 her saat kar\u015f\u0131l\u0131\u011f\u0131nda bir saat onbe\u015f dakikay\u0131 serbest zaman olarak kullanabilir.<\/strong><br>\u0130\u015f\u00e7i hak etti\u011fi serbest zaman\u0131 alt\u0131 ay zarf\u0131nda, \u00e7al\u0131\u015fma s\u00fcreleri i\u00e7inde ve \u00fccretinde bir kesinti olmadan kullan\u0131r.<br>63 \u00fcnc\u00fc maddenin son f\u0131kras\u0131nda yaz\u0131l\u0131 sa\u011fl\u0131k nedenlerine dayanan k\u0131sa veya s\u0131n\u0131rl\u0131 s\u00fcreli i\u015flerde ve 69 uncu maddede belirtilen gece \u00e7al\u0131\u015fmas\u0131nda fazla \u00e7al\u0131\u015fma yap\u0131lamaz.<br><strong>Fazla saatlerle \u00e7al\u0131\u015fmak i\u00e7in i\u015f\u00e7inin onay\u0131n\u0131n al\u0131nmas\u0131 gerekir.<br>Fazla \u00e7al\u0131\u015fma s\u00fcresinin toplam\u0131 bir y\u0131lda ikiy\u00fczyetmi\u015f saatten fazla olamaz.<\/strong><br>(Ek f\u0131kra: 10\/9\/2014-6552\/4 md.) Bu Kanunun 42 nci ve 43 \u00fcnc\u00fc maddelerinde say\u0131lan h\u00e2ller d\u0131\u015f\u0131nda yer alt\u0131nda maden i\u015flerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilere fazla \u00e7al\u0131\u015fma yapt\u0131r\u0131lamaz.<br>(Ek f\u0131kra: 10\/9\/2014-6552\/4 md.) Yer alt\u0131nda maden i\u015flerinde \u00e7al\u0131\u015fan i\u015f\u00e7ilere, bu Kanunun 42 nci ve 43 \u00fcnc\u00fc maddelerinde say\u0131lan h\u00e2llerde haftal\u0131k otuz yedi bu\u00e7uk saati a\u015fan her bir saat fazla \u00e7al\u0131\u015fma i\u00e7in verilecek \u00fccret, normal \u00e7al\u0131\u015fma \u00fccretinin saat ba\u015f\u0131na d\u00fc\u015fen miktar\u0131n\u0131n y\u00fczde y\u00fczden az olmamak \u00fczere artt\u0131r\u0131lmas\u0131 suretiyle \u00f6denir. (1)(2)<br>Fazla \u00e7al\u0131\u015fma ve fazla s\u00fcrelerle \u00e7al\u0131\u015fmalar\u0131n ne \u015fekilde uygulanaca\u011f\u0131 \u00e7\u0131kar\u0131lacak y\u00f6netmelikte g\u00f6sterilir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>FAZLA \u00c7ALI\u015eMAYA DA\u0130R B\u0130R EMSAL KARAR<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yarg\u0131tay emsal kararlar\u0131na g\u00f6re fazla \u00e7al\u0131\u015fma ve fazla \u00e7al\u0131\u015fma \u00fccreti \u015fu \u015fekildedir.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>9. Hukuk Dairesi &nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;2016\/12962 E. &nbsp;, &nbsp;2020\/1862 K.<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>&#8220;\u0130\u00e7tihat Metni&#8221;<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><br>MAHKEMES\u0130 :\u0130\u015e MAHKEMES\u0130<br><br>Taraflar aras\u0131nda g\u00f6r\u00fclen dava sonucunda verilen karar\u0131n, temyizen incelenmesi daval\u0131 vekili taraf\u0131ndan istenilmekle, temyiz taleplerinin s\u00fcresinde oldu\u011fu anla\u015f\u0131ld\u0131. Dava dosyas\u0131 i\u00e7in Tetkik Hakimi taraf\u0131ndan d\u00fczenlenen rapor dinlendikten sonra dosya incelendi, gere\u011fi konu\u015fulup d\u00fc\u015f\u00fcn\u00fcld\u00fc:<br><br><br>YARGITAY KARARI<br><br>A) Davac\u0131 \u0130steminin \u00d6zeti:<br>Davac\u0131 vekili dava dilek\u00e7esinde \u00f6zetle ;m\u00fcvekkilinin 16\/05\/2007 tarihinde daval\u0131 i\u015f yerinde yetkili yard\u0131mc\u0131 olarak i\u015fe ba\u015flad\u0131\u011f\u0131n\u0131, 2009 y\u0131l\u0131na kadar aral\u0131ks\u0131z \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, g\u00fcnde 3 saat fazla mesai yapt\u0131\u011f\u0131n\u0131, resmi tatiller ve genel tatillerde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131, 08\/10\/2009 tarihinde do\u011fum iznine ayr\u0131ld\u0131\u011f\u0131n\u0131, sonras\u0131nda ayn\u0131 \u015fekilde \u00e7al\u0131\u015fmaya devam etti\u011fini, ancak anne \u015fiftinden dolay\u0131 resmi tatil ve genel tatillerde \u00e7al\u0131\u015fmad\u0131\u011f\u0131n\u0131, 2 y\u0131lda bir terfi verilmesi gerekirken verilmedi\u011fini, bir y\u0131ll\u0131k izninin kulland\u0131r\u0131lmad\u0131\u011f\u0131n\u0131, &#8230; 21. Noterli\u011finin 21\/11\/2013 tarih ve 39375 yevmiye numaral\u0131 ihtar\u0131 i\u015f akdini 1475 SK. 14\/5 maddesi gere\u011fince emeklilik nedeniyle hakl\u0131 nedenle feshetti\u011fini ileri s\u00fcrerek,&nbsp;<mark>k\u0131dem tazminat\u0131<\/mark>,fazla mesai \u00fccreti,y\u0131ll\u0131k izin,cumartesi \u00e7al\u0131\u015fma \u00fccreti ve ulusal bayram ve genel tatil \u00fccreti alacaklar\u0131n\u0131 istemi\u015ftir.<br>B) Daval\u0131 Cevab\u0131n\u0131n \u00d6zeti:<br>Daval\u0131 vekili cevap dilek\u00e7esinde \u00f6zetle, emeklilik \u015fartlar\u0131n\u0131n olu\u015fmad\u0131\u011f\u0131n\u0131, iradesinin istifa oldu\u011funu, ba\u015fka bir i\u015f yerinde \u00e7al\u0131\u015f\u0131p \u00e7al\u0131\u015fmad\u0131\u011f\u0131n\u0131n ara\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fini, i\u015f yerinde fazla \u00e7al\u0131\u015fma yapabilecek \u00fcnvanlar\u0131n belirlendi\u011fini, davac\u0131n\u0131n bunlardan biri olmad\u0131\u011f\u0131n\u0131, hizmet s\u00f6zle\u015fmesinde fazla \u00e7al\u0131\u015fman\u0131n \u00fccret dahil oldu\u011funun belirtildi\u011fini, zaman a\u015f\u0131m\u0131 itirazlar\u0131n\u0131n bulundu\u011funu, \u00fccretlerin bankaya \u00f6dendi\u011fini ve hi\u00e7bir itiraz\u0131 kay\u0131t olmaks\u0131z\u0131n tahsil edildi\u011fini, y\u0131ll\u0131k izin alaca\u011f\u0131n\u0131n \u00f6dendi\u011fini, pazar g\u00fcn\u00fcn\u00fcn hafta tatili oldu\u011funu, cumartesi g\u00fcn\u00fc \u00e7al\u0131\u015fma \u00fccreti ve genel tatil \u00fccreti talebinin reddinin gerekti\u011fini savunarak,davac\u0131n\u0131n reddini savunmu\u015ftur.<br>C) Yerel Mahkeme Karar\u0131n\u0131n \u00d6zeti:<br>Mahkemece \u00f6zetle; SGK kay\u0131tlar\u0131,toplanan delillerin de\u011ferlendirilmesinde; davac\u0131n\u0131n daval\u0131 i\u015fverenlikte 16\/05\/2007-21\/11\/2013 tarihleri aras\u0131nda 6 y\u0131l 6 ay 5 g\u00fcn \u00e7al\u0131\u015ft\u0131\u011f\u0131,davac\u0131n\u0131n giydirilmi\u015f br\u00fct 2.710,16 TL oldu\u011funun anla\u015f\u0131ld\u0131\u011f\u0131, Yarg\u0131tay\u0131n istikrar kazanan son uygulamalar\u0131na g\u00f6re i\u015f akdini emeklilik nedeniyle sona erdiren i\u015f\u00e7inin bir ba\u015fka bir i\u015f yerinde \u00e7al\u0131\u015fmaya ba\u015flam\u0131\u015f olmas\u0131 yasal hak olan emeklilik nedeniyle i\u015f akdinin sona erdirmesini h\u00fck\u00fcms\u00fcz k\u0131lmayaca\u011f\u0131,buna g\u00f6re i\u015f\u00e7i yasal hakk\u0131n\u0131 kullanm\u0131\u015f olmas\u0131 nedeniyle&nbsp;<mark>k\u0131dem tazminat\u0131na<\/mark>&nbsp;hak kazanm\u0131\u015f olup ba\u015fka bir i\u015f yerinde yeniden i\u015fe girmi\u015f olmas\u0131 bu alaca\u011f\u0131n \u00f6denmemesi sonucunu do\u011furmayaca\u011f\u0131,haftal\u0131k ger\u00e7ekle\u015fen 46 saatlik \u00e7al\u0131\u015fmas\u0131n\u0131n 5 saatinin fazla s\u00fcrelerle \u00e7al\u0131\u015fma, 1 saatinin fazla \u00e7al\u0131\u015fma olarak ger\u00e7ekle\u015fti\u011fi, yine davac\u0131 taraf\u00e7a cumartesi g\u00fcnleri \u00e7al\u0131\u015fmalar\u0131 i\u00e7in ayr\u0131 bir talep ileri s\u00fcr\u00fcld\u00fc\u011f\u00fcnden cumartesi \u00e7al\u0131\u015fmas\u0131na y\u00f6nelik toplam 2 saat \u00e7al\u0131\u015fman\u0131n&nbsp;<mark>hesaplama<\/mark>&nbsp;d\u0131\u015f\u0131 b\u0131rak\u0131lmas\u0131 suretiyle 4 saatlik fazla \u00e7al\u0131\u015fma s\u00fcresine dair yap\u0131lan&nbsp;<mark>hesaplama<\/mark>&nbsp;mahkemece yeterli g\u00f6r\u00fclerek h\u00fck\u00fcm alt\u0131na al\u0131nd\u0131\u011f\u0131,davac\u0131n\u0131n cumartesi \u00e7al\u0131\u015fma \u00fccreti talebinde bulundu\u011fu,davac\u0131n\u0131n 4 haftada bir cumartesi 8 saat olmak \u00fczere , ortalama her cumartesi bir saat fazla s\u00fcreli \u00e7al\u0131\u015fma ve bir saat fazla \u00e7al\u0131\u015fma olmak \u00fczere iki saat \u00e7al\u0131\u015fma yapt\u0131\u011f\u0131na ili\u015fkin&nbsp;<mark>hesaplaman\u0131n<\/mark>&nbsp;mahkemece uygun g\u00f6r\u00fcld\u00fc\u011f\u00fc,davac\u0131n\u0131n \u00e7a\u011fr\u0131 merkezi gibi s\u00fcrekli \u00e7al\u0131\u015fan bir b\u00f6l\u00fcmde \u00e7al\u0131\u015f\u0131yor olmas\u0131 nedeniyle ulusal bayram ve genel tatil g\u00fcnlerinde de n\u00f6betle\u015fe \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131n anla\u015f\u0131ld\u0131\u011f\u0131,davac\u0131ya fiilen kulland\u0131\u011f\u0131 y\u0131ll\u0131k izinlerinin haricinde Aral\u0131k 2013 ay\u0131 bordrosu ile \u00f6deme yap\u0131ld\u0131\u011f\u0131 anla\u015f\u0131lmakla davac\u0131n\u0131n bakiye y\u0131ll\u0131k izin alaca\u011f\u0131n\u0131n kalmad\u0131\u011f\u0131 gerek\u00e7esi ile reddine karar verilmi\u015ftir.<br>D) Temyiz:<br>Karar\u0131 daval\u0131 temyiz etmi\u015ftir.<br>E) Gerek\u00e7e:<br>1- Dosyadaki yaz\u0131lara, toplanan delillerle karar\u0131n dayand\u0131\u011f\u0131 kanuni gerektirici sebeplere g\u00f6re daval\u0131 vekilinin a\u015fa\u011f\u0131daki bendin kapsam\u0131 d\u0131\u015f\u0131nda kalan temyiz itirazlar\u0131 yerinde de\u011fildir.<br>2- Somut uyu\u015fmazl\u0131kta bireysel veya toplu i\u015f s\u00f6zle\u015fmesinde aksine bir h\u00fck\u00fcm bulunmad\u0131\u011f\u0131 s\u00fcrece i\u015f\u00e7i ile i\u015fveren aras\u0131nda kararla\u015ft\u0131r\u0131lan ayl\u0131k maktu \u00fccret haftal\u0131k 45 saat \u00e7al\u0131\u015fman\u0131n kar\u015f\u0131l\u0131\u011f\u0131d\u0131r.Dosyada mevcut bireysel i\u015f s\u00f6zle\u015fmesi incelendi\u011finde haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresinin 40 saat olarak kararla\u015ft\u0131r\u0131ld\u0131\u011f\u0131na ili\u015fkin h\u00fck\u00fcm yoktur.A\u00e7\u0131klanan nedenle bilirki\u015finin daval\u0131 i\u015fyerindeki haftal\u0131k \u00e7al\u0131\u015fma saatini 40 saat olarak kabul\u00fc hukuki dayanaktan yoksundur.<br><strong>Dosyadaki bilgi ve belgelerden davac\u0131n\u0131n daval\u0131 i\u015fyerinde ayda bir yapt\u0131\u011f\u0131 anla\u015f\u0131lan cumartesi \u00e7al\u0131\u015fmas\u0131 da g\u00f6zetildi\u011finde ortalama haftada 46 saat \u00e7al\u0131\u015ft\u0131\u011f\u0131 ve 1 saat fazla mesai yapt\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r.Haftada bir saat fazla mesainin kar\u015f\u0131l\u0131\u011f\u0131 bilirki\u015fi taraf\u0131ndan 960,91 TL olarak hesaplanm\u0131\u015f olup,%30 takdiri indirim sonras\u0131 davac\u0131n\u0131n talep etti\u011fi fazla mesai alaca\u011f\u0131n\u0131n 672,64 TL olarak kabul\u00fc ve cumartesi \u00e7al\u0131\u015fmas\u0131 fazla mesai hesab\u0131nda de\u011ferlendirildi\u011finden ayr\u0131ca istenen cumartesi \u00e7al\u0131\u015fmas\u0131 alaca\u011f\u0131 talebinin ise reddi gerekti\u011finin d\u00fc\u015f\u00fcn\u00fclmemesi hatal\u0131 olup, bozmay\u0131 gerektirmi\u015ftir.<br><\/strong>F) Sonu\u00e7:<br>Temyiz olunan karar\u0131n, yukar\u0131da yaz\u0131l\u0131 sebepten dolay\u0131 BOZULMASINA, pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istek halinde ilgiliye iadesine 11.02.2020
