Ancak;<br><strong>1-Dava konusu ta\u015f\u0131nmaz\u0131n kamula\u015ft\u0131rmadan arta kalan, fen bilirki\u015fi raporunda C harfi ile g\u00f6sterilen 1505,08 m\u00b2 k\u0131sm\u0131n y\u00fcz\u00f6l\u00e7\u00fcm\u00fc, geometrik durumu, bilirki\u015fi raporundaki \u00f6zellikleri dikkate al\u0131nd\u0131\u011f\u0131nda bu k\u0131sma %40 oran\u0131nda de\u011fer kayb\u0131 hasaplanmas\u0131 gerekirken yaz\u0131l\u0131 \u015fekilde az bedele h\u00fckmedilmesi,<br><\/strong>2-Dava konusu ta\u015f\u0131nmazla ili\u015fkisi kalmayan &#8230;&#8217;\u00fcn karar ba\u015fl\u0131\u011f\u0131nda ad\u0131n\u0131n g\u00f6sterilmesi,<br>3-Kabule g\u00f6re de; h\u00fckmedilen 47.622,96 TL&#8217;den acele el koyma dosyas\u0131nda bloke edilen 22.750,00 TL bedelin mahsubu ile ilk kararda bloke edilen 15.474,55 TL&#8217;nin 18\/08\/2014 den ilk karar tarihi 14\/07\/2015 tarihine kadar, ikinci kararla h\u00fckmedilen fark bedel 9.398,41 TL&#8217;nin 18\/08\/2014 tarihinden karar kesinle\u015finceye kadar i\u015fleyecek yasal faizi ile \u00f6denmesine, bloke edilen faiz bedellerinin ve \u00f6nceki \u00f6demelerin m\u00fckerrer \u00f6demeye sebebiyet vermeyecek \u015fekilde dikkate al\u0131nmas\u0131na, fazla bloke edilenin talep halinde davac\u0131 idareye iadesine karar verilmesi gerekirken<strong> infazda teredd\u00fct uyand\u0131racak \u015fekilde h\u00fck\u00fcm kurulmas\u0131,Do\u011fru g\u00f6r\u00fclmemi\u015ftir.<\/strong>Daval\u0131 &#8230; vekilinin temyiz itirazlar\u0131 yerinde oldu\u011fundan h\u00fckm\u00fcn a\u00e7\u0131klanan nedenlerle BOZULMASINA, pe\u015fin al\u0131nan temyiz harc\u0131n\u0131n istenildi\u011finde iadesine ve temyize ba\u015fvurma harc\u0131n\u0131n Hazineye irad kaydedilmesine, 12\/03\/2020 g\u00fcn\u00fcnde oybirli\u011fiyle karar verildi.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>5.
